As a reminder, H-1B sponsorship requires that a verified offer of employment (or equivalent agreement/contract) is in place before OIS may begin processing an H-1B Request. This assumes that all standard search and selection steps have already been completed.
In addition, H-1B regulations require that the H-1B worker begin employment within a certain day limit of the start date. The individual may not be “benched” from beginning employment. This means that all criminal background and pre-employment steps must be completed before the start date is reached.
To ensure that the H-1B worker has the best chance of meeting employment start date requirements, OIS is now asking that a copy of the appointment form approval email from the Office of Access and Equity (OAE) be attached to the H-1B request form.
OIS advisors will review the timing and documentation requirements for an H-1B petition at the Sponsoring H-1B Specialty Workers workshop on April 4. In the meantime, department administrators may review the H-1B information included in the Guide to Hiring or Inviting Foreign Nationals to UIC, download request forms, and contact OIS with questions.
